Mother sues son for selling her flat 'without permission'


 A 75-year-old woman is suing her son and his wife for selling her four-room flat while she was overseas.

The Straits Times reported today that Madam Nelukkara Mohamed Abdullah Fatimah Zaharah was in India looking for a bride for her youngest son when she received a call from another son informing her that her Telok Blangah residence had been sold.

She has now taken her 39-year-old son, tourism officer Mr Zulfikar Ali Kappukal Abdul Wahab Kashmiri, and his wife to court to recover the $430,000 in sales proceeds.

The widow claims that he had disposed of the asset without her permission.

In his defence, Mr Zulfikar Ali said she had always wanted to sell the flat and give the proceeds to him and his younger brother.

According to the English daily, court documents filed by Madam Nelukkara's lawyer state that she signed an authorisation document at a law firm on April 16, 2009 which gave him the power of attorney to rent out the flat while she was away.

However, Madam Nelukkara said she was not told that it also gave him the power to sell the flat.

Shocked

Madam Nelukkara said she was shocked to receive the call from Mr Zulfikar Ali telling her that the flat had been sold.

After she returned on Dec 28 that year, she found that the payment had been deposited into a joint account held by her and Mr Zulfikar Ali.

However, a large portion of the money had been withdrawn by him, she said.

According to The Straits Times, Madam Nelukkara said in court papers that Mr Zulfikar Ali paid his younger brother only $130,000.

He is also alleged to have withdrawn $422,220 from the account to buy a $290,000 flat in Eunos Crescent.
